A new company has won a $20 million lawsuit over alleged sexual and medical misconduct by Pfizer Inc. in the USA, but the company was forced to pay $2.8 million in damages for its allegedly illegal marketing of the drug, which is commonly known as Cialis.
The drug, which is sold under the brand name Cialis, was promoted to treat impotence, erectile dysfunction (ED), and benign prostatic hyperplasia (BPH).
The lawsuit claims Pfizer failed to adequately warn patients about the drug's potential side effects and the drug is not approved for that purpose.
Pfizer's alleged conduct caused some of the drug's sales to plummet.
"Pfizer's sexual dysfunction product, Cialis, was promoted to treat erectile dysfunction and benign prostatic hyperplasia by an FDA-approved product called Tadalafil," according to the lawsuit.
"Pfizer promoted Cialis to treat sexual dysfunction in men," according to the lawsuit.
Pfizer also received a settlement in the USA regarding the sales of its Cialis and a $5 million judgment against the company in a federal court case that was resolved in April.
Pfizer has claimed that the lawsuit claims it failed to warn consumers about Cialis' potential side effects, the FDA said in a statement. The company, based in Indianapolis, Indiana, was not named in the suit.
The lawsuit alleged Pfizer marketed Cialis to treat ED and BPH symptoms by promoting the drug as a "high blood pressure drug" and to treat ED and BPH by promoting the drug to treat BPH and sexual function problems.
Pfizer also sought damages for "unfair and deceptive trade practices" and consumer fraud that the FDA alleged were being promoted and used in the drug's sales.
"The FDA's decision to approve the drug for marketing purposes is a violation of the anti-competitive and anticompetitive conduct provision of the federal Food, Drug and Cosmetic Act," the lawsuit said.
The FDA said that in 2010, the agency approved the use of Cialis in the treatment of erectile dysfunction and benign prostatic hyperplasia.
The lawsuit contends the FDA improperly promoted the drug as a "high blood pressure drug" and used that promotion for the purpose of inducing patients to buy the drug.
"The FDA's actions violate the anti-competitive conduct provision of the federal Food, Drug, and Cosmetic Act," the lawsuit said.
"Pfizer's promotion of Cialis to treat erectile dysfunction and benign prostatic hyperplasia is an attempt to increase the incidence of these conditions," the lawsuit added.
The lawsuit alleged Pfizer used its sales of the drug to promote the drug to treat BPH and sexual function problems.
"Pfizer was forced to pay $2.8 million in damages for its alleged illegal promotion and conduct," according to the lawsuit.
The lawsuit claims the company's conduct was also the result of misleading advertising for the drug.
